These Terms & Conditions ("Terms") apply to all bookings made with Yuǎn Shān Travel ("Yuǎn Shān", "we", "us"). By booking a trip with us, you confirm that you have read, understood, and accepted these Terms. For questions, contact us at info@yuanshantravel.com.
1. Our Services
We organise small-group adventure journeys in China based on pre-set itineraries with fixed departure dates. Itineraries may deviate slightly for individual participants by arrangement, and optional add-on programmes are available before or after each trip. We provide the full organisation and guidance of the trip, including accommodation and ground transportation as described in the itinerary. International and domestic flights to and from the trip's starting point are not included unless explicitly stated.
2. Prices & What's Included
The trip price includes the services explicitly listed in the itinerary, typically: guiding, organisation, accommodation, ground transportation during the trip, and the activities and meals specified. Not included unless stated: flights, visas, travel insurance, vaccinations, personal expenses, drinks, tips, and any optional activities or add-on programmes.
Prices are confirmed at the time of booking. We reserve the right to correct obvious errors in published prices and to adjust prices before booking due to changes in exchange rates, transport costs, or government charges. The price of a confirmed booking will not be increased.
3. Booking & Payment
Your booking is confirmed upon receipt of a deposit of 25% of the trip price. The remaining balance is payable as follows:
- 25% no later than 120 days before departure
- 50% (remaining balance) no later than 90 days before departure
If you book within 120 days of departure, all instalments that would already have fallen due are payable at the time of booking. If any payment is not received by its due date, we may treat the booking as cancelled by you, and the cancellation charges in Section 4 will apply.
4. Cancellation by You
You may cancel your booking free of charge within 24 hours of booking, provided the departure date is more than 30 days away. After this 24-hour window, the deposit is non-refundable and the following charges apply, calculated as a percentage of the total trip price and based on the date we receive your written cancellation notice:
- More than 120 days before departure: deposit (25%)
- 120 – 91 days: 30%
- 90 – 61 days: 50%
- 60 – 31 days: 75%
- 30 – 15 days: 90%
- 14 days or fewer: 100%
We strongly recommend taking out cancellation insurance to cover these charges.
5. Changes & Transfers by You
If you wish to transfer your booking to another departure date or to another person, contact us as early as possible. We will accommodate such requests where availability and our suppliers allow. Transfers are subject to any additional costs we incur, and a transfer requested within 90 days of departure may be treated as a cancellation under Section 4. A person taking over a booking must meet all participation requirements in these Terms.
6. Cancellation or Changes by Us
Our trips require a minimum number of participants. If this minimum is not reached, we may cancel the departure. In that case we will first propose alternative departure dates; if no alternative suits you, you will receive a full refund of all amounts paid, including your deposit. We are not liable for other costs you may have incurred, such as flights, visas, or insurance.
We may also modify or cancel a trip where circumstances beyond our control require it (including weather conditions, natural events, governmental or political restrictions, or safety concerns). Where a trip is materially changed before departure, we will offer you the choice of accepting the change, transferring to another departure, or — where the change is significant and caused by us — a refund. During the trip, our guides may adjust the itinerary where conditions require; no refund is due for itinerary changes made for safety or operational reasons.
7. Unused Services & Early Departure
No refund is given for any services you do not use, or if you leave the trip early — whether by your own choice, due to illness or injury, or following removal under Section 9. Any additional costs arising from an early departure (such as return transport or extra accommodation) are at your own expense.
8. Your Responsibilities
You are responsible for arranging, at your own cost:
- Flights to and from the trip's starting and ending points
- A valid passport (we recommend at least six months' validity beyond your return date) and any required visas for entering China
- Vaccinations and health requirements applicable to your itinerary
- Comprehensive travel and medical insurance, including coverage for trekking and high-altitude activities and emergency evacuation, valid for the full duration of the trip
We arrange supplementary group insurance covering specific mountain activities included in the itinerary; this does not replace your personal travel and medical insurance.
You are also responsible for your personal belongings throughout the trip. We accept no liability for loss, theft, or damage to luggage, equipment, or personal items.
9. Health, Fitness & Conduct
Our trips involve trekking and adventure activities that require a good level of physical fitness. We review each participant's fitness level before confirming a booking and may ask for additional information. You must inform us of any medical conditions that could affect your ability to participate safely.
We reserve the right to refuse a booking, or to remove a participant from a trip, where their health, fitness level, or conduct — including excessive alcohol consumption or behaviour endangering themselves, the group, or our staff — compromises the safety or enjoyment of the trip. In such cases no refund will be given, and any resulting costs (such as early return travel) are borne by the participant.
Medical emergencies. If you suffer illness or injury during a trip and are unable to make decisions yourself, you authorise our guides to arrange medical treatment, evacuation, or hospitalisation on your behalf where reasonably necessary. All resulting costs are your responsibility (or that of your insurer).
10. Age Requirement
All participants must be 18 years or older at the time of departure.
11. Optional Activities
Activities that are not part of the published itinerary — including activities offered locally by third parties during free time — are not part of your contract with us. You undertake such activities at your own risk and expense.
12. Risks & Liability
Our trips take place in remote regions of China and include trekking, high-altitude, and other adventure activities that carry inherent risks. By booking, you acknowledge and accept these risks.
To the fullest extent permitted by law, we are not liable for:
- Injury, loss, or damage arising from weather conditions, natural events, or terrain
- Political situations, governmental actions, or travel restrictions
- Delays, cancellations, or failures of transport providers
- Accidents occurring during hikes, climbs, or other adventure activities
- Acts or omissions of third-party service providers (hotels, transport operators, local operators)
- Force majeure events
Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by our negligence. Where we are liable, our total liability is limited to the price paid for the trip.
13. Photos & Videos
During our trips, we or other participants may take photos and videos in which you appear. You agree that we may use this content for marketing purposes (including our website and social media) unless you object by emailing info@yuanshantravel.com — before, during, or after the trip. We will honour any objection promptly.
14. Privacy
We process your personal data (including health and fitness information you provide) only to organise and operate your trip, and we share it with suppliers (such as hotels and local operators) only where necessary for that purpose. We do not sell your data to third parties.
15. Complaints
If a problem arises during your trip, please raise it immediately with your guide so we can try to resolve it on the spot. If the issue is not resolved to your satisfaction, submit a written complaint to info@yuanshantravel.com within 30 days of the end of the trip.
16. Governing Law & Disputes
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from or relating to these Terms or your trip shall be submitted to the exclusive jurisdiction of the courts of Hong Kong.
17. Changes to These Terms; Severability
We may update these Terms from time to time. The version in force at the time of your booking applies to your trip. The current version is always available on this page. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
